Spindale Town Council Approves New Guidelines for North Slope Skatepark to Comply with State Law

On Monday, Nov. 17, the Spindale Town Council unanimously approved updated operational and safety guidelines for the North Slope Skatepark, bringing the facility into compliance with North Carolina state law on hazardous recreational activities.


The new ordinance sets the skatepark’s hours of operation from sunrise to 10 p.m. and requires all participants to wear a helmet, elbow pads, and knee pads, as mandated by G.S. § 99E-23(a). Parents and guardians are responsible for ensuring minors follow these safety requirements.


Town officials stressed that the regulations protect both participants and the town from liability. The guidelines reference the state’s Hazardous Recreation Parks Safety and Liability statutes, which recognize the inherent risks of skateboarding, inline skating, and freestyle bicycling.


“Skateboarding and similar activities carry risks that participants must assume,” said Town Manager Scott Webber. “Our goal is to provide a fun, accessible space while complying with state law.” The ordinance passage minimizes potential legal exposure for the town.


Violations of the new rules are considered infractions under G.S. § 14-4, with fines up to $50. Serious or repeated violations may result in removal from the facility and prohibition from future use. Posted signage will inform users of these requirements.


State law clarifies that governmental entities are not liable for injuries or damages from participation in designated hazardous recreational areas, provided required safety notices are posted. Exceptions include gross negligence or failure to warn of hidden dangers.


The council noted that the ordinance fulfills a key part of G.S. §§ 99E-21 through 99E-25, encouraging municipalities to make land available for skateboarding while acknowledging inherent risks.


The North Slope Skatepark is a popular destination for youth and families, and the town hopes the updated guidelines will provide clarity for users and help maintain a safe recreational environment.


Signs outlining the new rules and safety requirements will be posted throughout the park in the coming weeks, with town staff monitoring compliance.


The ordinance took effect immediately.
