Tri-City Violent Crimes Task Force and Rutherford County Aggressive

Criminal Enforcement went to 741 Spindale St in Spindale, NC after several complaints

were made about narcotics activity. While knocking on the residence door, Detectives

could readily smell the odor of marijuana.

Detectives were able to make contact with the occupants of 741 Spindale St at which

point the smell of burnt marijuana was overwhelmingly coming from the open door way.

Detectives began to speak with Samuel Dayshaun Boyce who gave consent to search

the residence. On entering the residence, more probable cause of drug activity was

observed.

Mr. Boyce revoked his consent to search the residence at which point a search warrant

was applied for and granted. A thorough search of the residence was completed at

which point evidence was discovered that Mr. Boyce and his girlfriend, Daiysha Carson

had possibly destroyed narcotics by dumping it into the homes toilet. As a result of the

attempted destruction of evidence, a preliminary field test of the water from the toilet

was conducted. The field test indicated that it possibly contained fentanyl or cocaine.

The contents of the toilet were seized to be submitted to the North Carolina SBI for

future charges. Underneath the bathroom sink, numerous wet baggies were recovered.

The baggies appeared to have previously contained narcotics.

During the search, a total 4 individual baggies of fentanyl were recovered, each

weighing approximately .1 gram or a “point”, which is the common dosage for fentanyl

sales. In addition, a Diamondback 9mm pistol, a bottle of MSM (Methylsulfonylmethane)

powder, $761 in US currency, drug paraphernalia and a small amount of marijuana was

recovered. MSM (Methylsulfonylmethane) powder is a common cutting agent for

narcotics, which is something added to narcotics to increase the weight of the illegal

drug to further its sale and distribution.

As a result of the search warrant, the following charges were made:

Samuel Dayshaun Boyce

-Possession of Fentanyl

-Possession of Marijuana

-Maintaining a Dwelling for Controlled Substances

Daiysha Lenae Carson

-Possession of Fentanyl
